Classification of the current draft bill on the regulation of deepfakes

The Federal Ministry of Justice wants to take targeted action against deepfakes with a new draft law - the Research Centre has analysed the draft and takes a position on the proposed offences in a current statement.

Recent incidents involving manipulated image and video recordings of celebrities have massively accelerated the debate about the risks of generative AI. The focus is particularly on the protection of general personal rights against AI-supported misuse. The Federal Ministry of Justice has responded to this with a draft law that aims to criminalise specific types of behaviour when dealing with deepfakes. But which offences are actually covered by this? Does the draft effectively close the existing gaps in protection, or does it ignore key areas of application for generative software?
