The Court of Justice of the European Union clarifies that ‘by effect’ restrictions under Article 101(1) TFEU do not require the proof of actual restrictive effects but only sufficiently appreciable potential restrictive effects on competition, thus aligning the interpretation of this provision with that of Article 102 TFEU.
